Employers confused about new sick time rules

Michigan’s Earned Sick Time Act is in effect, but many business owners are still unsure if they’re in compliance.

Nearly all of Michigan employers are impacted by the new rules, though some are set to be included in the upcoming months and years.

Michigan Department of Labor and Economic Opportunity Deputy Director Sean Egan hosted a webinar this week to answer some of those questions. He said one of the only exemptions for the sick time rules are for U.S. government and rail workers.

We did find in the previous law and this one, there is a federal preemption issue around workers that are employed by the railway or railway employers or  that are covered by the Railway Unemployment Insurance Act,” Egan said.

As for small businesses, that’s ten or fewer employees. The new sick time laws do not go into effect until October if you’re an established business. Some newer businesses may have another three years to comply, pushing that date to 2028.
